Payment Terms

KMEIRE Limited placement fee is 10 % of the candidates annual remuneration.
The fee, which is subject to VAT, is invoiced once an offer of employment is made and accepted. Payment is due 14 days after the day that the candidate commences employment.

General Conditions

(1) These terms and conditions are the basis of an agreement for placement service between KMEIRE Limited and the Client and are deemed to be accepted by virtue of the client conducting an interview with a candidate introduced by KMEIRE.

(2) The fee is payable in the event of the candidate accepting an offer of employment whether under a contract of service or a contract f or services.

(3) The fee is payable in the event the client offers any position to the candidate during a period of 12 months after the original introduction.

(4) KMEIRE Limited does check candidate references but the client should take steps to obtain confirmation of the applicants suitability, skills and integrity at interview. KMEIRE Limited cannot accept liability for any injury to persons, loss or damage to property or any other loss arising directly or indirectly from acts or omissions of any candidate introduced to the client. These terms of business regulate the basis upon which KMEIRE Ltd introduces candidates to the Client and they are deemed to be accepted by the Client upon the Clients receipt of details of Candidates or to commence a recruitment assignment or agreement to interview or offer of employment to any Candidate whose details are submitted to the Client by the Recruitment Consultancy.

(5) In these terms of business the following definitions are used unless the context otherwise requires:
    - a. Recruitment Consultancy” means KMEIRE LIMITED;
    - b. Candidate means a person who may be suitable for a position with the Client or whom the Client may wish to be introduced to.
    - c. Client means the person, firm or corporate body requiring the services of the recruitment Consultancy;
    - d. Engagement” means the acceptance by a Candidate, either orally or in writing, of an offer of a position to the Candidate whether or not that position is the same to which the interview related and whether the offer is oral or in writing;
    - e. Fee means the percentage of the Remuneration Package which is payable by the Client to the Recruitment Consultancy for the introduction of the Candidate as set out in the Fee Structure;
    - f. Remuneration means the aggregate gross annual emoluments payable to or receivable by a Candidate pursuant to an Engagement including bonuses, overseas premium, living allowance, profit share and all other financial emoluments that form part of gross taxable pay, and including value for appointments with a company car and including subsidised mortgage or housing allowance . If bonuses are not guaranteed they will be deemed to be two-thirds of the likely bonus quoted.

(6) These terms of business are the complete and only terms of business between parties. No variations to the terms of business shall be effected unless confirmed in writing and signed by a director of the Recruitment Consultancy.

(7) The Client shall be solely responsible for satisfying itself as to the proficiency and integrity of a Candidate and shall be responsible for taking up any references (including the confirmation of any professional or academic qualifications) and for arranging all medical and other examinations of, either express or implied, on the introduction of any Candidate to the Client. The Recruitment Consultancy will accept no liability for any loss, costs, expenses, damages or delay howsoever occasioned which the Client, its servants, agents, clients or others may suffer or become liable for arising out of or in connection with the introduction to or employment by the Client of any Candidate.

(8) The Recruitment Consultancy shall not be liable to the Client for any loss of profit or other costs, including but not limited to failures arising from the Year 2006 onwards ,except in respect of death or personal injury caused by the Recruitment Consultancys negligence.

(9) The Client shall pay the Fee, in accordance with the agreed Fee Structure, within 14 Days of invoice. VAT, if applicable, shall be payable by the Client in addition to the Fee. Fees are calculated, at the discretion of the Recruitment Consultancy, in Euro, irrespective of the currency in which the remuneration package is expressed.

(10) For Contract and temporary and specially agreed retained assignments, the initial contract fee is payable on acceptance of the assignment, the second stage Placement fees is payable on presentation of our invoice (or 14 days after commencement of the assignment) and the completion fee, adjusted to reflect finally agreed salary package, when an appointment has been made.

(11) For file search, no fee is payable until an appointment has been made.

(12) If the Client fails to make any payment when due the Recruitment Consultancy shall be entitled to charge interest on the amount unpaid at the rate of 3% above the base rate, from time to time.

(13) In the event that a Candidate, introduced by the Recruitment Consultancy, is rejected by the Client or rejects the Clients offer of employment and is subsequently employed by the Client, in any capacity, within 12 months of the original introduction then such Engagement shall be an Engagement within the terms hereof and the Fee shall be payable by the Client in accordance with these terms of business.

(14) The Client shall notify The Recruitment Consultancy immediately after its offer of Engagement to the Candidate has been verbally accepted and shall provide details of the full remuneration package to the Recruitment Consultancy within one working day.

(15) In the event that a client effects an introduction of any Candidate originally introduced to it by the Recruitment Consultancy to any third party which results in the employment of that Candidate by that third party within 12 months of the initial introduction date by the Recruitment Consultancy then the Fee shall be payable by the Client as if the Engagement has been within the terms hereof.

(16) In the event that an offer of employment, whether orally or in writing, has been made to a Candidate and accepted by the Candidate, the Client shall be liable to pay the Fee as if there had been an Engagement within the terms hereof regardless of if the offer is later withdrawn.

(17) In the event that the Recruitment Consultancy incurs expenses relating to an Engagement or a proposed Engagement, whether verbally or in writing with the Client, then such expenses shall be involved in addition to the Fee and shall be payable by the Client within 14 days of the invoice date. Should the Client request the Recruitment Consultancy to pay the Candidates expenses directly, an administration charge of 10% will be payable.

Guarantee: KMEIRE provide a guarantee of the suitability of selected candidates as follows:
      - The guarantee commences on the day the candidate takes up employment with the client and continues for a period of 12 weeks.
      - In the event the candidate leaves or is discharged, as unsuitable, during the guarantee period KMEIRE will use its best endeavours to provide a suitable replacement.
      - If a suitable alternative is not provided within the guarantee period or after Four weeks of been advised of unsuitability then a refund will be made per the scale below:

      5 - 8 weeks    50%
      9 - 12 weeks  30%

Note: the guarantee only applies to accounts operated in accordance with the payment terms below. In the event that the Client requires special Consultancy projects the Fee shall be agreed in writing with the Recruitment Consultancy prior to the commencement of the assignment.

(18) All information supplied by the Recruitment Consultancy is confidential and intended for the exclusive use of the Client and the Recruitment Consultancy shall accept no liability for any loss or damage occasioned through the disclosure by the Client of such Information.

(19) If an offer of employment is made to any employee or former employee of the Recruitment Consultancy by the Client or one of its subsidiaries, the Client shall be liable to pay a Fee amounting to 20% of the Candidates salary.

(20) The Recruitment Consultancy has separate terms of business for the introduction of the temporary staff, which are available on request.

(21) These terms of business shall be governed by and construed in accordance with Irish Law. These laws and conditions are effective from the commencement of KMEIRE Business registration as a limited company.
